These are the Terms & Conditions of Service for couples booking Azayda Photography — how a date is reserved, what the coverage includes, how photographs are delivered, and how personal use works.

The signed booking agreement and written quote for your date form the agreement between you and Azayda. Bass will walk you through them before you sign. If anything is unclear, ask before booking rather than after.

This agreement is between you, the client, and Azayda Photography, the photographer.

THE AGREEMENT

The signed booking agreement, the written quote for your date, and any later written variations accepted by both parties form the agreement between you and Azayda Photography. They set out the collection, coverage hours, number of photographers, retainer, balance, optional extras and any other agreed charges. This page explains the service terms and does not replace the signed documents.

If any part of the agreement is found to be invalid or unenforceable, the rest remains in effect. A change or waiver is only effective when agreed in writing.

BOOKING AND DATE RESERVATION

An enquiry or conversation does not reserve a date. Your date and coverage times are reserved when the booking agreement has been signed and the retainer described in the written quote has cleared, unless the written agreement says otherwise.

The retainer is applied to the agreed service price. Unless the signed booking agreement says otherwise, it is not refundable when a client cancels because the date has been held for that booking. Nothing in these terms limits a right or remedy that cannot lawfully be excluded.

PLANNING AND COOPERATION

Bass will discuss the day with you and provide reasonable timeline, light, location and family-photo guidance. You should provide the confirmed schedule, locations, key timings and any important family or accessibility information in good time.

You are responsible for making people and details available when they are needed and for telling Bass about any must-have photographs. Bass cannot guarantee a photograph of a person, detail or moment where the subject is unavailable, timing changes, information was not provided, or a person does not wish to participate.

PRICING AND PAYMENT

The prices published at /pricing/ are the current dated rate card in Australian dollars. They can change at any time. A price is locked only when it is confirmed in your written quote and your date is booked.

Your written quote states the retainer, balance and due dates. Unless it says otherwise, the remaining balance is payable before or on the day of the wedding. Optional albums and additional coverage are quoted on top of a collection and are not included unless written into your quote.

Parking, permits, venue charges, taxi or rideshare costs, and other travel or service expenses not included in the quote will be discussed with you and are payable where they are reasonably required for the agreed service. If a balance is overdue, Bass may pause further performance or delivery only as permitted by the written agreement and applicable law.

COVERAGE, SCHEDULE AND EXTRA HOURS

Coverage starts and finishes at the times in the written quote. Please confirm the final schedule and notify Bass promptly of changes to timing or location. Delays or changes may reduce the time available for other parts of the agreed coverage.

Extra coverage is subject to availability and must be agreed in writing. The published additional-hour rate is $200 per hour with one photographer and $300 per hour with two photographers, unless your written quote states a different agreed rate.

SAFETY

Bass may pause or end coverage if a person’s behaviour is threatening, abusive, discriminatory or unsafe, or if the safety of anyone at the event is at serious risk. Bass will communicate with you where it is reasonably safe to do so. Any payment or refund consequences remain subject to the signed agreement and applicable law.

VENUE RULES AND PERMISSIONS

You are responsible for obtaining permissions and permits required by your venues and for notifying Bass of venue rules, restrictions, access conditions and photography fees. Bass will work within reasonable venue restrictions, but cannot be responsible for photographs prevented by rules, restricted access, weather, lighting, obstructions or conditions outside Bass’s control.

PHOTOGRAPHY STYLE, SELECTION AND EDITING

Bass photographs with documentary observation, calm direction and lighting where it helps, alongside editorial portraits and the ordinary moments of the day. You acknowledge that photography is creative work and that the final selection, colour, editing style, composition and presentation are determined by Bass’s professional judgement.

Not every exposure is delivered. The delivered work is the finished collection Bass selects and edits from the photographs made during the agreed coverage.

DELIVERY AND ARCHIVE

Bass edits and curates every wedding personally. Editing usually takes 6 to 8 weeks. This is a typical turnaround, not a guaranteed deadline, unless your written agreement expressly says otherwise.

Every finished photograph included in your collection is delivered at full resolution through a private link. You receive full personal print rights to the delivered photographs. Download the files when the link is provided and keep your own backup.

COPYRIGHT AND PERSONAL USE

Copyright remains with Bass and Azayda Photography. After full payment, you receive a perpetual, non-exclusive licence to download, store, print and share the delivered photographs for personal use, including personal social media and sharing with family and friends.

You must not sell, licence, materially alter for commercial use, or use the photographs in advertising or other commercial activity without written permission. Any use by a business, venue or supplier should be agreed in writing with Bass.

PROMOTIONAL USE AND PRIVACY

Any permission for Azayda to use images of you for its portfolio, website, social media, awards, editorial or marketing is governed by the publicity consent recorded in your signed booking agreement. Tell Bass before booking if you need a particular privacy restriction discussed or recorded.

You cannot give permission on behalf of every guest. Tell Bass about known restrictions, and Bass will take reasonable care when working with them. The separate Privacy Notice explains how enquiry information is handled.

CANCELLATION, RESCHEDULING AND UNAVOIDABLE EVENTS

If you need to cancel or move your wedding, contact Bass promptly in writing. A new date may be accepted if Bass is available and both parties confirm the change in writing. A move is not guaranteed and may require a new quote where the season, coverage or services change.

Neither party is responsible for failing to perform where an event outside reasonable control makes performance impossible or unsafe, such as serious illness, accident, natural disaster, government direction, venue closure, transport disruption or another comparable event. Both parties will communicate promptly and make reasonable efforts to find a workable alternative. If no alternative is agreed, the cancellation and payment terms in the signed agreement apply, subject to applicable law.

IF BASS CANNOT PERFORM

If Bass cannot perform the agreed service, Bass will make reasonable efforts to arrange a suitable replacement photographer for your approval. If no suitable replacement is available, payments received for the part of the service not performed will be returned, subject to the signed agreement and applicable law.

LIMITS AND CONSUMER RIGHTS

To the extent permitted by law, liability for a loss caused by circumstances outside Bass’s reasonable control is limited to the amount paid for the affected service. This does not limit liability that cannot lawfully be limited, including liability for fraud, intentional misconduct or rights under the Australian Consumer Law.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel the service contract and obtain a refund for the unused portion.
